Negligence

The failure to use a reasonable amount of care in doing/not doing something, resulting in harm to another person.

Strict Liability

The legal responsibility for damage/injury, even if you're not negligent.

Standard of Proof

Level of uncertainty/degree of evidence needed to establish proof. Civil cases, preponderance of evidence

Preponderance of Evidence

Standard of proof, have to fulfill, where each party tries to provide more-convincing evidence.

Waive

To give up right, privilege, or benefit voluntarily.

Class Action

Lawsuit brought by one or more people, on behalf of a larger group.

Contingency Fee

Fee paid to attorney based on percentage of sum client gets in lawsuit.

Premiums

Payments made for insurance coverage.

Malpractice

Failure to meet an practice standard in professional/official position

Exclusive Remedy

The only solution or compensation available to a plaintiff in a particular legal situation.
